How to check for a licensed Nebraska medical cannabis dispensary
As of October 6, 2026, Nebraska had no licensed medical cannabis dispensaries. The commission had not opened dispensary applications.1 So no one in Nebraska is licensed to sell cannabis to patients yet. If someone offers to sell you “Nebraska medical cannabis,” don’t buy it.

1. Check the commission’s licensing page
- Go to the commission’s licensing page .
- Look for the part about dispensary applications. On October 6, 2026, it said the dispensary application period had not opened and was waiting on action by the Legislature.1
- Until the commission licenses dispensaries and lists them on its website, no store, website or person is licensed to sell medical cannabis to patients in Nebraska.
The commission has licensed cultivators (growers). Its rules do not let cultivators or product makers sell or give cannabis to patients or caregivers.2
2. What the patient law allows now
Under state law, it is not a crime for a qualified patient to use, have and get up to 5 ounces of cannabis. A caregiver may get it for the patient and bring it to them.43
- Who qualifies: adults 18 and older with a written recommendation from a physician, osteopathic physician, physician assistant or nurse practitioner. Patients under 18 also need written permission from a parent or legal guardian.3
- The recommendation: a signed and dated statement that, in the practitioner’s judgment, the benefits of cannabis outweigh the harms for your condition. It lasts two years, or less if the practitioner says so.3
- Caregivers: an adult patient can name a caregiver who is 21 or older in a signed affidavit.3

3. When dispensaries open: what the rules say
- In person only. A dispensary may sell only at its licensed store. It may not deliver.2
- Paperwork first. Your practitioner must send the dispensary your written recommendation and a written order. The dispensary must check your photo ID.2
- Limits. No more than a 30-day supply at a time, and no more than 5 grams of total THC for one patient in 90 days.2
- Allowed forms. Pills, capsules, tinctures, topicals, suppositories, patches, nasal sprays, and liquids for a nebulizer or inhaler. Flower, smoking or vaping, and food or drinks made with cannabis are not allowed.2
- Package and label. Child-resistant, tamper-evident, resealable packages, with warnings and the maker’s name. The dispensary adds a label with your name, your practitioner’s name and its own name.2
Warning signs
- Anyone selling “medical cannabis” in Nebraska now. No dispensary is licensed yet.1
- Flower, vapes, gummies or drinks sold as Nebraska medical cannabis. The commission’s rules do not allow these forms at all.2
- Products shaped like people, animals or cannabis leaves. The rules ban these shapes.2
Hemp and CBD shops are not part of the medical program
Nebraska’s medical cannabis law says cannabis does not include hemp.3 A hemp or CBD shop is not a medical cannabis dispensary, and its products are not covered by the commission’s testing and label rules.
If something doesn’t look right
There are no licensed sellers yet, so there is no license to complain about. You can still contact the commission with questions or concerns through its online form or by phone at 402-471-1531 .5 If someone is selling cannabis illegally, you can contact local law enforcement.
